02 — General Principles

How we handle your data

DATAlysis Sagl processes personal data exclusively in accordance with the Swiss Federal Act on Data Protection (nDSG) and, where applicable, the EU General Data Protection Regulation (GDPR) for visitors based in the European Economic Area.

We collect only the data that is necessary for the stated purpose, retain it no longer than required, and do not sell or share it with third parties for marketing purposes.

03 — Data We Collect

What is collected and why

Server & Access Logs

Data collected: IP address (anonymised), browser type, operating system, referring URL, pages visited, date and time of access.

Purpose: Ensuring the technical operation and security of the website.

Legal basis: Legitimate interest (Art. 6 nDSG).

Retention: Log files are retained for a maximum of 30 days, then deleted automatically.

Hosting: This website is hosted by Infomaniak Network SA, Rue Eugène-Marziano 25, 1227 Genève, Switzerland. All server infrastructure is located in Switzerland.

Contact Form

Data collected: Name, email address, and the content of your message.

Purpose: Processing and responding to your enquiry.

Legal basis: Performance of a contract or pre-contractual measures; alternatively, your consent by voluntarily submitting the form.

Retention: Correspondence is retained for as long as necessary to handle your request, and for up to 10 years thereafter where required by Swiss commercial or accounting law (OR, SR 220).

Disclosure: Data submitted via the contact form is not disclosed to third parties, unless required by law or necessary to fulfil your request.

Spam protection: The contact form is protected by hCaptcha (see §5) to prevent automated submissions. When the contact page loads, hCaptcha JavaScript is executed and data is sent to Intuition Machines, Inc. in the USA.

Website Analytics

Tool: We use Matomo, an open-source analytics platform self-hosted on our own server infrastructure at Infomaniak in Switzerland. No data is transmitted to Matomo.org or any third party.

Cookieless & consent-free: Our Matomo instance is configured in cookieless mode. No analytics cookies or local storage identifiers are placed on your device. As a result, this analytics setup does not require your prior consent under Swiss or EU data protection law.

Data collected: Anonymised IP address (last two octets masked before storage), pages visited, time spent, referral source, browser type, and device category. Only aggregated, anonymous statistics are retained — no individual visitor profiles, session recordings, or personally identifiable data are stored.

CNIL-compliant configuration: Matomo is configured in accordance with the French CNIL consent-exemption conditions, which represent a high standard of privacy-by-design analytics. This includes two-byte IP masking, disabled cross-domain tracking, stripped advertising identifiers, disabled Visits Log and Visitor Profiles, and data rounded to the nearest ten to prevent singling out individuals.

Retention: All analytics data is automatically purged after 180 days.

Legal basis: Legitimate interest (Art. 6 nDSG). No cross-border data transfer occurs.

Opt-out: You can exclude yourself from analytics measurement at any time using the opt-out widget below. The preference is stored as a small cookie on your device; clearing your cookies will reset it.

04 — Cookies

Cookies and Local Storage

This website sets no analytics cookies. Our Matomo analytics runs in cookieless mode and does not place any tracking identifier on your device.

The only cookies that may be set are those originating from YouTube, and only if you actively choose to play an embedded video (see §5). These are third-party cookies set by Google LLC and are governed by Google's own cookie policy.

An opt-out preference cookie may be set if you use the Matomo opt-out form above. It contains no personal data and is used solely to record your tracking preference.

The contact page loads the hCaptcha widget, which sets a persistent cookie (hmt_id, valid for 365 days) and may set session cookies on your device before any user interaction. These cookies are set by Intuition Machines, Inc. and are governed by the hCaptcha Privacy Policy. Blocking these cookies may prevent the contact form from functioning.

You can delete or block cookies at any time through your browser settings without affecting the functionality of this website (except the contact form, which requires hCaptcha cookies).

05 — Third-Party Services

External Content Embedded on This Site

YouTube Videos

Some pages of this website may embed videos hosted by YouTube LLC, 901 Cherry Ave., San Bruno, CA 94066, USA, a subsidiary of Google LLC.

Privacy-enhanced mode: Where technically possible, we use YouTube's privacy-enhanced embed URL (youtube-nocookie.com), which limits the cookies YouTube sets until you actively click play.

Data transferred to Google: When you interact with an embedded video, your browser establishes a direct connection to YouTube's servers. Google may collect your IP address, information about the video watched, and device/browser data. This data is processed by Google LLC in the United States.

Cross-border transfer: The USA is not on Switzerland's list of countries with an adequate level of data protection. Google relies on Standard Contractual Clauses (SCCs) approved by the European Commission as the transfer mechanism. For details, see Google's Privacy Policy.

Legal basis: Your consent, expressed by clicking play on the embedded video.

hCaptcha (Spam Protection)

Tool: The contact form uses hCaptcha, provided by Intuition Machines, Inc., 548 Market St Suite 95149, San Francisco, CA 94104, USA.

Purpose: Distinguishing human users from automated bots to prevent spam submissions on the contact form.

Data collected: IP address, browser type and version, operating system, screen resolution, device fingerprint, and interaction behaviour (cursor movements, timing). The cookies described in §4 are also set. Data collection begins when the contact page loads, before any user interaction with the form.

Cross-border transfer: Data is transferred to Intuition Machines, Inc. in the USA, which is not on Switzerland's list of countries with an adequate level of data protection. Intuition Machines relies on Standard Contractual Clauses (SCCs) as the transfer mechanism. For details, see the hCaptcha Privacy Policy.

Legal basis: Legitimate interest (Art. 6 nDSG) — preventing spam and ensuring the integrity of the contact form.

06 — Cross-Border Data Transfers

Where Your Data Goes

All primary data processing (server logs, contact form submissions, analytics) takes place in Switzerland on Infomaniak infrastructure. No personal data is transferred abroad in the ordinary course of operating this website.

One exception is YouTube video playback (§5), which involves a transfer to Google LLC in the USA, contingent on your active choice to play a video.

A second exception is the hCaptcha widget embedded in the contact form (§5), which transfers device and interaction data to Intuition Machines, Inc. in the USA whenever the contact page is loaded.

07 — Your Rights

Rights Under the nDSG

As a data subject under Swiss law, you have the following rights. To exercise any of them, contact us at (loading, js required). We will respond within 30 days.

  • Access You may request confirmation of whether we process data about you, and obtain a copy of that data (Art. 25 nDSG).
  • Rectification You may request correction of inaccurate or incomplete personal data (Art. 32 nDSG).
  • Erasure You may request deletion of your personal data, subject to any legal retention obligations.
  • Portability You may request a machine-readable copy of data you have provided to us (Art. 28 nDSG).
  • Objection You may object to processing based on legitimate interest. We will cease processing unless we can demonstrate compelling legitimate grounds.
  • Withdraw consent Where processing is based on your consent, you may withdraw it at any time without affecting the lawfulness of prior processing.
  • Complaint You have the right to lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC) at edoeb.admin.ch .

We may update this Privacy Policy from time to time to reflect changes in the law, our services, or data processing practices. The current version is always available at datalysis.ch/legal/privacy-policy. The date at the top of the page indicates when it was last revised.
